多くのオンライン小売業者に対し、ニューヨーク州に発送する購入品について売上税を徴収するよう義務付けた新しいニューヨーク州法、いわゆる「Amazon 税」法に対し、Eコマース大手 Amazon.com が法的手段による対抗措置に出た。議論の的になっている同法は、業者がニューヨーク州内で事業を行なっておらず、また、州内に勤務する従業員がいない場合でも適用される。

マンハッタンにあるニューヨーク州最高裁判所に提訴した Amazon は、同法が「無効、違法、かつ違憲なものだ」とする宣言的判決が下されることを望んでいる。

Amazon のこうした動きは、大方の予想どおりのものだ。

州予算案の通過に伴ないニューヨーク州議会が4月9日に承認した同法は、Amazon だけでなく、販売促進手段としてマーケティングにアフィリエイト プログラムを利用している他のオンライン小売業者にも適用される。

一般的なアフィリエイト プログラムでは、Web サイト所有者が自分のサイトに小売業者へのリンクを設置し、そのリンクを通じて商品が売れると手数料を受け取ることができる。

新法では、オンライン小売業者がアフィリエイト プログラムを通じて、ニューヨーク州において少なくとも年間1万ドルの売上を上げた場合、発送する購入品について売上税を徴収する義務が生じることになる...
